Data Protection Notice

1. Data Controller

This notice is issued by Tusan Motor San. ve Tic. Ltd. Şti. in its capacity as data controller, under Article 10 of Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") and, where applicable, Articles 13–14 of the General Data Protection Regulation ("GDPR").

2. Personal Data We Process

tusanmotor.com has no forms, accounts or comment fields; no personal data is collected through the site. We process personal data only when you email us or call us, and only what you share in that correspondence:

Identity data: your first and last name.
Contact data: your email address and/or telephone number.
Professional data: the organisation or company name you mention, if any.
Request content: the subject of the message or call you send us.

If you only browse the site, no data that identifies you is collected.

3. Purposes of Processing

The data listed above is processed for the following purposes:

Responding to and resolving the requests, questions and complaints you submit.
Evaluating information, demonstration and quotation requests for our products and services.
Assessing dealership, corporate procurement and partnership applications.
Operating technical service and after-sales support processes.
Ensuring information security and preventing abuse.
Meeting our legal obligations and evidencing our position in any dispute.

4. Legal Grounds

We rely on the following legal grounds, set out in Article 5 of the KVKK and Article 6 of the GDPR:

Necessity for the conclusion or performance of a contract — for your quotation, demonstration and supply requests.
Compliance with a legal obligation to which the controller is subject.
The legitimate interests of the controller, provided your fundamental rights and freedoms are not overridden — for request handling and information security.
Your explicit consent, for any processing outside the grounds above.

5. Transfers of Personal Data

Your data may be shared, only to the extent necessary for the purposes above, with our hosting and email infrastructure providers, our legal advisers, and competent public authorities.

We never sell, rent or otherwise transfer your personal data to third parties for marketing purposes.

6. Method of Collection

Your personal data is collected only when you email or call us, by non-fully-automated means. No automated data collection takes place through tusanmotor.com.

7. Retention Period

Personal data obtained through requests you send by email or telephone is retained for a maximum of two (2) years after your request has been resolved, after which it is deleted, destroyed or anonymised.

Where a contractual relationship is established, the limitation and retention periods laid down in the applicable legislation apply.

8. Your Rights

By applying to the data controller, you may exercise the following rights:

To learn whether your personal data is being processed.
To request information about the processing, if any.
To learn the purpose of processing and whether the data is used in line with that purpose.
To know the third parties to whom the data has been transferred, domestically or abroad.
To request rectification of incomplete or inaccurate data.
To request erasure or destruction of your data.
To request that rectification, erasure or destruction be notified to third-party recipients.
To object to a decision based solely on automated processing that produces an adverse effect on you.
To claim compensation for damage arising from unlawful processing.
To request restriction of processing and data portability, where the GDPR applies.

9. How to Apply

You may submit requests concerning the rights above in writing to our registered address, through a registered electronic mail (KEP) address, or by email to info@tusanmotor.com from the address registered in our systems.

Your application is concluded free of charge as soon as possible and in any event within thirty (30) days. Where the process entails an additional cost, a fee set by the Turkish Personal Data Protection Board may be charged.

You also have the right to lodge a complaint with the Turkish Personal Data Protection Authority or with the supervisory authority in your country of residence.
